A NEW Zealand environmental and social justice campaigner has been charged with burgling a Dublin shoe shop on the day of last November’s riots in the city.
Jack Brazil (30) was granted bail when he appeared in Dublin District Court today.
Mr Brazil, with an address at Crossguns Quay, Phibsborough, Dublin is charged with burglary at Foot Locker, O’Connell Street on November 23 last year.
Garda Brian Kenny told the court Mr Brazil was arrested yesterday, charged at 7.46pm and replied after caution: “I reserve the right to provide further exculpatory evidence.”
He was handed a copy of the charge sheet.
Gda Kenny said there were no objections to bail subject to conditions.
Judge Bryan Smyth adjourned the case for DPP directions.
Judge Smyth granted bail in the accused’s own bond of €200, with no cash lodgement required. Under conditions, Mr Brazil is to sign on weekly at Mountjoy garda station and be contactable at all times on a phone number to be provided to gardai within 48 hours of taking up bail.
He is also to provide an address to gardai within 48 hours and keep a night time curfew there between 12am and 6am. He must not loiter in the Dublin 1 or 2 areas and is to undertake not to apply for travel documents, after surrendering his passport.
Mr Brazil is to be of good behaviour and attend all court dates.
The accused had offered details of an alibi to gardaí and was seeking the earliest possible adjournment date, his solicitor Aoife McNicholl said.
Gda Kenny said statements had not been taken from these people yet.
Ms McNicholl said Mr Brazil was “impecunious at present” and the case was having a “detrimental effect.”
The judge remanded the accused on bail to appear in court again on January 29. He granted free legal aid after hearing Mr Brazil was not working and had no assets
